AIsier web app, paid with Stripe
Version: 1.0 · This page is the general text of the contract; when you buy, the filled-in version opens from the checkout screen and is sent to your e-mail.
Article 1. Parties
1.1. Provider: AIsier Inc. ("AIsier" or "we"). Place of incorporation: Delaware, United States of America. Address: 131 Continental Dr, Suite 305, Newark, DE 19713, United States of America. E-mail: hello@aisierinvest.com. Phone: we do not have a phone line yet; the fastest way to reach us is e-mail. MERSİS / tax identification number: we have no MERSİS registration and no tax identification number in Turkey.
1.2. Consumer: The owner of the AIsier account making the purchase ("you").
1.3. You declare that you form this contract for purposes outside any trade or profession and that you are at least 18 years old or have the approval of your legal representative (your parent or guardian).
Article 2. Subject and annexes
2.1. The product you buy: the plan or credit pack you choose on the checkout screen. Product type: subscription or credit pack. This contract governs the electronic provision of this product to you, paid with Stripe in the web app at aisierinvest.com, and the rights and obligations of the parties under Turkey's Consumer Protection Law No. 6502 and the Distance Contracts Regulation.
2.2. The Pre-Contract Information Form shown to you when you buy is an integral part of this contract.
2.3. The general rules for using the service are in the Terms of Use (https://aisierinvest.com/terms.html). If this contract and the Terms of Use conflict, this contract applies to this web purchase.
2.4. This contract does not cover purchases made through the App Store or Google Play. For those purchases Apple or Google carries out the sale under its own terms; payment, cancellation and refunds follow that store's rules.
Article 3. Essential characteristics of the service
3.1. AIsier Investment Assistant is an app that lets you track your investments and read AI-written summaries based on market data. AIsier does not give investment advice: its content is general information and is not a recommendation to buy, sell or hold any asset. Your investment decisions and their results are yours.
3.2. Credits: The AI features use three kinds of credits. Silver covers quick looks, gold covers deep analyses; diamonds are used only in the chat with AIsier. Which credit a feature uses and how many are shown on that feature's button in the app; the full list of features is in Profile. You can convert gold, silver and diamonds into each other at the rates shown in the app. Credits are assigned to your account, cannot be transferred to another account and cannot be exchanged for money. Credits spent on an operation whose result could not be produced at all because of a technical problem are returned to your account.
For subscriptions
3.3. Subscription:
- Plan and billing period: The plan you choose on the checkout screen; billed monthly or yearly. A plan paid monthly makes you a Premium member, a plan paid yearly a VIP member.
- Credits you receive each calendar month: the amount of credits shown on the checkout screen. Every plan unlocks all features of the app; the plans differ only in the amount of credits you receive each month.
- Your credit allowance renews on the first day of each calendar month at 03:00 Turkey time (00:00 UTC); on the yearly plan it also renews every month. A monthly allowance you do not use does not carry over to the next month.
- When your subscription starts, the allowance for the current calendar month is assigned; credits you spent during a trial in the same month are deducted from it. If you subscribe during a trial, your paid subscription starts at once; the remaining trial days are not added to your subscription.
- When you use a feature, it is first deducted from that month's plan allowance; when your plan allowance runs out, your other credits that have an expiry (e.g. game rewards) are used, and last your purchased pack credits, which do not expire.
- While your yearly (VIP) membership lasts, you buy extra credit packs at the lower VIP price.
- When the subscription ends, your monthly credit allowance stops; credits you bought in packs stay usable.
For credit packs
3.3. Credit pack:
- Pack: the amount of credits shown on the checkout screen, one-off.
- The credits are loaded to your account as soon as your payment is confirmed. They do not expire, do not renew and need no subscription to use.
- If you have a subscription, that month's plan allowance is spent first, then your other credits that have an expiry, and your pack credits last.
3.4. Access: You use the service with the same account in an up-to-date web browser with an internet connection at https://aisierinvest.com/app/ and in the AIsier apps on the App Store and Google Play. You need to sign in to your account to use the service; apart from this there is no technical protection measure that restricts the functionality of the digital content.
3.5. What stays free: The basic tracking features and following five markets are free on every account; this contract governs the paid credit allowances and membership benefits.
3.6. Fair use: To prevent abuse, short-term usage limits apply to some operations (Terms of Use, "Acceptable use").
Article 4. Price and payment
4.1. Total price: The price shown on the checkout screen, including all taxes. We add no tax, commission or other charge on top of this amount.
For subscriptions
4.2. Periodic payment: This amount is the price of each monthly or yearly period. You pay the first period when the contract is formed; the fee for each following period is charged automatically to your saved card on the day the period starts. First renewal date: the date shown on the checkout screen. While your subscription lasts, renewals are made at the price stated in this contract; later price changes apply only to new purchases. If you change your plan, the new plan's price on that day applies (Article 6.4). If you have a valid promotion code you can enter it on the Stripe checkout page; the discounted amount is shown on that page before you confirm the payment and the amount you pay goes below this price.
For credit packs
4.2. One-off payment: You pay this amount once; the pack does not renew.
4.3. Payment method: You pay on Stripe's secure checkout page with a debit or credit card, in a single charge; there are no instalments. Your card details are entered on Stripe's page and never reach us.
4.4. Bank charges: The bank that issued your card may apply an exchange rate difference or a transaction fee for a transaction in a foreign currency; that charge is between you and your bank and is not paid to us.
For subscriptions
4.5. Payment documents: You can see the documents for your subscription payments in the invoice history of the Stripe customer portal.
4.6. Unchanged terms: During the contract, the monthly credit amount assigned to you and the credit costs of features are not changed to your disadvantage for a period you have paid for. We notify you by e-mail at least 30 days in advance of a change to your disadvantage that will apply from the next period; if you do not accept it, you can end your subscription under Article 7.
For credit packs
4.5. Payment record: The order confirmation e-mail is the record of this payment (Article 5.4).
Article 5. Formation and performance of the contract
5.1. Formation: You confirm that you have read the Pre-Contract Information Form and received the pre-contract information, approve this contract and confirm the payment on the Stripe checkout page. The contract is formed as soon as Stripe confirms your payment. If you do not confirm that you received the pre-contract information, the contract is not formed.
5.2. Performance: The service starts as soon as your payment is confirmed, without further waiting.
For subscriptions
Your membership becomes active and the credits for the current calendar month become available in your account.
For credit packs
The credits are loaded to your account.
5.3. Non-performance: If the service does not start after your payment is confirmed, write to hello@aisierinvest.com. If we cannot start the service as promised, you can terminate the contract; in that case we refund the full amount you paid, with statutory interest, within 14 days from the date your termination notice reaches us.
5.4. Order confirmation: Once your payment is confirmed we send your order confirmation by e-mail to your account's e-mail address together with filled-in copies of this contract and the Pre-Contract Information Form.
Article 6. Term and renewal
For subscriptions
6.1. Term: This subscription is for an indefinite term. Billing period: monthly or yearly. The subscription renews automatically at the end of each period until you cancel it or it ends under this contract.
6.2. Renewal payment: The renewal fee is charged to your saved card on the day the new period starts (Article 4.2). If the payment fails, Stripe may retry it; your membership continues during this time. If the payment still cannot be collected the subscription may end; when it ends we tell you by e-mail (Article 7.5).
6.3. Changing your card: You can change your saved card in the Stripe customer portal that opens with the "Manage or cancel" link on the subscription page of the web app.
6.4. Plan changes: While your subscription lasts you can change your plan in the same portal. A move to a plan with a higher monthly equivalent starts at once: the remaining amount of your current plan is credited to your payment and the difference is charged at once. A move to a plan with a lower monthly equivalent (e.g. from the monthly to the yearly version of the same plan) and a move from yearly to monthly start at the end of the current period.
For credit packs
6.1. A credit pack is one-off; it has no term and does not renew. The contract is performed when the credits are loaded to your account. The credits you buy do not expire.
Article 7. Termination and refunds
For subscriptions
7.1. Right to end at any time: You can end your subscription at any time, without giving a reason and without paying a penalty (Law No. 6502 Art. 52(4)). The way you do this is no harder than the way you started the subscription.
7.2. Stopping renewal: You can cancel your subscription in the Stripe customer portal ("Manage or cancel") or by e-mail to hello@aisierinvest.com. The cancellation takes effect at the end of the current period: until then your membership and credit allowance continue, and no payment is taken for the next period.
7.3. Ending at once and refunds: On the monthly plan the fee for the current period is not refunded; the termination takes effect at the end of that period. On the yearly plan, if you want your subscription to end at once, write to hello@aisierinvest.com: we end your subscription within 7 days at the latest after your request reaches us and, within 15 days of the end date, refund one twelfth of the yearly fee for each full month remaining after the end date to the card you paid with, without deductions.
7.4. Account deletion: If you delete your account, your web subscription is cancelled at the same time and no further payment is taken from you; all credits in your account are deleted too. If you want a refund of the remaining full months on the yearly plan, write to hello@aisierinvest.com before deleting your account.
7.5. End notice: We tell you by e-mail when your subscription ends.
For credit packs
7.1. Because a credit pack has no right of withdrawal (Article 8), the pack price is not refunded except in the cases of a defective service in Article 9.
7.2. If you delete your account, your unused credits are deleted with it.
Article 8. Right of withdrawal
8.1. In distance contracts the consumer has the right to withdraw from the contract within 14 days without giving any reason and without paying a penalty (Law No. 6502 Art. 48(4)). Article 15 of the Distance Contracts Regulation, however, exempts some contracts from this right, and this contract is one of those exceptions.
For subscriptions
8.2. With your approval, the service starts as soon as your payment is confirmed, before the withdrawal period ends (Regulation Art. 15(1)(h)), and that month's credits are delivered instantly to your account in electronic form (Regulation Art. 15(1)(ğ)); therefore a subscription has no right of withdrawal. Before moving to the payment page, you expressly confirmed, by ticking a separate box, that you want the service to start at once and that you know you therefore have no right of withdrawal. Having no right of withdrawal does not affect your right to end your subscription under Article 7.
For credit packs
8.2. Credits are intangible goods delivered instantly in electronic form; therefore a credit pack has no right of withdrawal (Regulation Art. 15(1)(ğ)). Before moving to the payment page, you expressly confirmed, by ticking a separate box, that you want the credits loaded to your account as soon as your payment is confirmed and that you know you therefore have no right of withdrawal.
8.3. No purchase can be made without this confirmation.
8.4. If, because of an error, a sale went through without this confirmation, or a right of withdrawal arose for another reason, it is enough to notify your decision within 14 days of the day the contract was formed by e-mail to hello@aisierinvest.com or in writing to the postal address in Article 1.1. You can use the model withdrawal form annexed to the Regulation or state your decision clearly. Within 14 days of the date your notice reaches us, we refund all payments we collected to the card you paid with, in one go and without charging you.
Article 9. Defective service
If the credits are not loaded to your account or the service does not match the characteristics in this contract and the Pre-Contract Information Form, you can use one of your optional rights under Article 15 of Law No. 6502: the service being performed again (e.g. the credits being loaded), a price reduction in proportion to the defect, or withdrawing from the contract (a refund of the price). It is enough to write your request to hello@aisierinvest.com. If you choose a reduction or withdrawal, we refund the related amount without delay; if you choose the service to be performed again, we do so within 30 working days at the latest.
Article 10. Other obligations of the parties
10.1. We: provide the service in line with this contract and the Pre-Contract Information Form; confirm your order by e-mail; keep the information and documents on this transaction under Article 12.
10.2. You: protect your account's sign-in details, use an e-mail address you can access and use the service in line with the Terms of Use.
Article 11. Personal data
We explain how your personal data is processed in the KVKK Privacy Notice (https://aisierinvest.com/kvkk-aydinlatma.html) and the Privacy Policy (https://aisierinvest.com/privacy.html). Approving this contract does not mean you give explicit consent to the processing of your personal data.
Article 12. Notices, copies and retention
12.1. Our notices to you are sent by e-mail to your account's e-mail address. You send your notices to hello@aisierinvest.com or to the postal address in Article 1.1. E-mail counts as a durable medium.
12.2. We keep this contract, the Pre-Contract Information Form, the confirmation records and the payment records for 3 years; even if you delete your account, these records are kept for this period as the law requires. On request we send you a copy by e-mail.
Article 13. Dispute resolution and governing law
13.1. You can send your complaints to hello@aisierinvest.com or to our postal address; we look into them and reply to you by e-mail.
13.2. If the value of the dispute is below the monetary limit the Ministry of Trade announces each year, you apply to the consumer arbitration committee where you live or where you made the transaction. You can also apply through e-Devlet with the Consumer Information System (TÜBİS).
13.3. For disputes above this limit you can go to the consumer court, on condition that you apply to a mediator before filing the case. You can file the case at the consumer court where you live.
13.4. This contract is governed by Turkish law; the mandatory provisions protecting the consumer are reserved in all cases.
Article 14. Entry into force and language
14.1. This contract enters into force as soon as your payment is confirmed under Article 5.1.
14.2. This contract is drawn up in Turkish. If it conflicts with a text in another language, the Turkish text prevails.
